USER AGREEMENT
(public offer of PPCHANGE.COM.UA)
1. General Provisions
1.1. This User Agreement (the “Agreement”) defines the rules and conditions for using the online service PPCHANGE.COM.UA (the “Service”).
1.2. The Parties to the Agreement are the Service and any legally capable individual using the Service (the “User”).
1.3. Submitting a request (Order) on the Service’s website means the User fully and unconditionally agrees with this Agreement. If the User does not agree with the terms, use of the Service is prohibited.
1.4. The current version of the Agreement is publicly available on PPCHANGE.COM.UA and may be amended by the Service unilaterally. Changes take effect from the moment of publication, unless stated otherwise.
2. Terms and Definitions
Service — the PPCHANGE.COM.UA web platform providing exchange services of electronic assets / electronic money / fiat funds according to the listed directions.
User — an individual who has accepted the Agreement and creates/executes Orders via the Service.
Payment System — a third-party software/technical solution (banks, payment providers, crypto exchanges, etc.) that maintains accounts and processes transfers.
Electronic Asset — a digital representation of monetary or other obligations (cryptocurrency, electronic money, etc.).
Operation / Payment — the transfer of currency/asset from payer to recipient.
Order — an electronic form on the Service’s website indicating the direction, amount, details and other conditions of the exchange.
Source Currency — the asset/currency transferred by the User to the Service.
Result Currency — the asset/currency received by the User from the Service as a result of the exchange.
Currency Reserve — the amount of a certain asset available to the Service at the time of Order creation.
Rate — the value ratio between currencies/assets used during the exchange.
3. Subject of the Agreement
3.1. The Service provides the User with currency / electronic asset exchange services within the available directions, rules and limits published on PPCHANGE.COM.UA.
3.2. The Service operates in accordance with the laws of Ukraine and its internal KYC/AML policies.
4. Service Provision and Interaction Procedure
4.1. Services are ordered by creating an Order through the web interface of the Service with an exchange calculator, without mandatory registration.
4.2. The Order status, parameters and other information are available to the User via the Service’s interface and/or e-mail. Each Order is assigned a unique number.
4.3. The Service processes Orders subject to the regulations of relevant payment systems/networks, technical capabilities, and available reserves.
4.4. The Service is not a party to legal relations between a Payment System and its clients and is not liable for failures/delays on the side of third-party services.
4.5. Important — KYC/AML: the sender and recipient of funds within one Order must be the same person (third-party payments are prohibited). The details specified in the Order must belong to the User.
4.6. The User confirms the legal origin of funds/assets and their lawful use.
4.7. The User is solely responsible for declaring and paying taxes in accordance with their tax status and jurisdiction.
5. Fees, Rates and Commissions
5.1. Service fees, applicable exchange rates and commissions are shown on the website during Order creation.
5.2. The Service reserves the right to change rates/fees at any time before the Source Currency is credited to the Service’s accounts (see section 7 on rate fixation).
5.3. The Order shows the rate, payment system/network fees and calculated amounts to be sent/received.
6. Account and Security
6.1. During registration (if applicable), the User must provide accurate information. The Service may request additional information/documents (ID, selfie verification, proof of funds’ origin, etc.).
6.2. The Service may limit or suspend access to the account or execution of Orders for data verification or in case of suspicious activity.
6.3. The User is responsible for keeping login credentials confidential and for all actions performed in their account.
6.4. Use of anonymization services (VPN, Tor, proxies) when creating Orders is prohibited.
6.5. If violations or risk-related behavior are detected, the Service may suspend Order execution, reject new Orders and/or initiate KYC checks.
7. Currency / Asset Exchange
7.1. By creating an Order, the User authorizes the Service to exchange the Source Currency to the Result Currency according to the chosen direction.
7.2. The User transfers the Source Currency in full, as specified in the Order instructions. After receipt, the Service sends the Result Currency, taking into account the applicable rate and fees.
7.3. The crediting/payout time depends on the direction, operation of payment systems/banks/networks and may range from several minutes to 2 business days.
7.4. The Order must be paid strictly to the details provided for that specific Order. Transfers using details from previous Orders are not allowed.
7.5. The Service’s obligation to pay is deemed fulfilled when the Result Currency is debited from the Service’s accounts in the corresponding system, as confirmed by its logs / transaction hash.
7.6. The Service may cancel an Order if the Source Currency is not received within the time indicated in the interface (usually 24 hours). If payment arrives later, the Order may be re-processed at the rate valid at the moment of actual receipt.
7.7. Rate fixation: the exchange rate is fixed at the moment of Order creation.
7.8. The Service may set minimum/maximum limits. Violating such limits may result in refusal to execute the Order or recalculation of conditions.
7.9. AML check of addresses/details: if high risk is detected, the Service may suspend the operation and request video verification and/or proof of funds’ origin.
7.10. If an asset is sent via an incorrect network, the possibility of recovery depends on technical feasibility and is subject to deduction of expenses and network fees.
7.11. The list of platforms/categories with which the Service does not work, or which require enhanced verification, is defined in the KYC/AML Policy on the website. Operations related to such entities may be blocked.
8. Effective Date and Acceptance
8.1. This Agreement constitutes a public offer. Acceptance is deemed complete when the User finalizes an Order on PPCHANGE.COM.UA.
8.2. The date/time of acceptance and Order parameters are recorded automatically.
8.3. The User has the right to cancel an Order before payment is made.
9. Liability and Force Majeure
9.1. The Service’s liability to the User cannot exceed the value of assets/funds actually entrusted to the Service under the relevant Order.
9.2. The Service is not liable for failures/errors/delays in the operation of payment systems, banks, blockchain networks, internet providers and any losses arising therefrom.
9.3. The Service provides exchange services only and does not perform cash collection, acquiring of goods/services of third parties, or trust management of funds.
9.4. The User is responsible for the accuracy of data in the Order; any error in details may result in loss of funds/assets.
9.5. Information about an Operation is stored in the Service’s internal systems and may be used as evidence in case of disputes.
9.6. The Parties are released from liability in the event of force majeure (war, terrorist acts, power/network outages, regulatory bans, etc.) that makes it impossible to fulfill obligations.
10. Refunds
10.1. A refund is possible only if the exchange has not been completed (the Result Currency has not been sent to the User), except in cases of AML-related blocking until checks are completed.
10.2. Refunds are made in the Source Currency minus network/bank/technical costs and, if necessary, rate differences at the time of recovery operations.
10.3. The refund process is initiated after the User contacts the Service support team.
10.4. Refunds of “invalid/test/fake” assets are not made.
10.5. If, after a successful payout, funds are automatically returned by a bank/payment system to the Service’s details, repeated transfers to the User are not guaranteed; the Service provides confirmation of the initial payout.
11. Other Provisions
11.1. The Service may update this Agreement by publishing a new version on the website.
11.2. The Service may refuse to accept/execute an Order without explanation, with a subsequent refund in accordance with section 10.
11.3. For security reasons, the Service may temporarily suspend website/operations for maintenance.
11.4. The Service may send system notifications regarding Order status to the e-mail specified by the User; this is an integral part of the process.
11.5. Personal data is processed in accordance with the PPCHANGE.COM.UA Privacy Policy.
